This End User License Agreement ("EULA") is a legal agreement between you and Code Fundi for any Code Fundi software we make available for installation on your devices ("Software"), together with our online Services terms where they apply.
Subject to this EULA and your compliance with it, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for your internal business or personal purposes in accordance with documentation and applicable plan limits.

The Software may include third-party or open-source components governed by their respective licenses. Those licenses apply to the extent they conflict with this EULA only for those components.
We may provide updates, patches, or new versions. Updates may be subject to additional terms presented at install time. Continued use after update constitutes acceptance unless prohibited by law.
Code Fundi and its licensors retain all right, title, and interest in the Software. No rights are granted except as expressly stated.
Your license ends automatically if you breach this EULA. Upon termination you must cease use and uninstall the Software. Sections intended to survive will survive.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODE FUNDI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THE SOFTWARE. AGGREGATE LIABILITY FOR THE SOFTWARE WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $100 IF NO FEES APPLIED, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You represent that you are not located in a country subject to embargoes or sanctions that prohibit use of the Software, and that you will comply with applicable export control laws.
